Welcome to PC Print Care! The terms and conditions in these Terms of Service (these “Terms”) govern your use of the PC Print Care website at https://pcprintcare.online/ (the “Site”) and PC Print Care, Inc.’s features, products, and services (collectively, the “Service”) through the Site. These Terms comprise the “Agreement” between you and PC Print Care.

By accepting these Terms, you consent to arbitration of all disputes as outlined in Section 19. These Terms allow only individual arbitration between you and PC Print Care, and they do not allow class or representative arbitration claims.

The Service allows customers (“Customer”) to find a professional to offer the requested technical support (“Configuration ”). A Customer will use the Service to select services and schedule on-demand technical support with the Configuration (“Booking”). Customers and other Service users are collectively referred to as “Users”. The “Platform” includes the Services and Site.

The Platform is operated in the US and should not be used by European Economic Area residents.

By agreeing to these Terms, including by a click-through or other agreement, or by using any part of the Platform, you expressly acknowledge that (a) you have read and agree to all of their terms and conditions, (b) you are 18 years of age or older, (c) you have the right, authority, and capacity to enter into this Agreement, and (d) if you are entering into this Agreement on behalf of an entity, you have authority to act on its behalf and

These Terms contain crucial Platform usage terms. They cover how we provide the Platform, how we or you may terminate the Services and/or access to the Platform, how you must manage your User account (an “Account”), and how we handle disputes (which usually includes a class action waiver and binding arbitration).

1. Updates PC Print Care may amend these Terms at its discretion and post the new version on the Site. You agree that using any part of the Platform after the amended Terms are posted will constitute acceptance of the updated Terms. If you disagree with any of these Terms, you must discontinue using the Platform. Disputes under these Terms will be settled according to the version in effect at the time. To keep up with changes, please review these Terms often.

2. Platform Provision You are responsible for your Internet connection, data consumption, and telecommunications rates when accessing the Platform. You agree that PC Print Care may update any part of the Platform without notice.

3. Platform shutdown In its sole discretion, PC Print Care may deny usage of the Platform to any individual or business. You recognize and agree that PC Print Care may stop providing any part of the Platform or restrict your use of the Platform without notice for any reason. If PC Print Care disables your Account, you may not be able to access the Platform, your Account details, or your Account contents.

4. User Security and Accounts
4.1 User Account You need an Account to use some Platform features. You can register on the Site to create an Account. You may need to provide personal information to register or utilize the Platform. You promise to provide PC Print Care with accurate, up-to-date registration information. You may not use a username that is (a) intended to impersonate another person, (b) subject to any rights of a third party with necessary authorization, or (c) offensive, vulgar, or obscene.

4.2. Account Security
Account security is crucial. You’re responsible for protecting your Account password and all Account actions. You agree to alert PC Print Care immediately of any unauthorized password or Account use.

4.3. Sharing or transferring user accounts
Personal accounts cannot be transferred under any circumstances. You should not reveal your Account or password.

4.4 Your Deactivation
You can delete your account anytime. Email [email protected] to delete your account. We may store inactive account and order history.

4.5. PC Print Care termination
PC Print Care may terminate your Account for any reason or no reason, including if: (a) PC Print Care determines that you are (i) in breach of or otherwise acting inconsistently with these Terms or (ii) engaging in fraudulent or illegal activities or other conduct that may result in liability to PC Print Care; (b) PC Print Care determines that it is required by law to terminate your Account; or (c) PC Print Care decides to stop providing the Platform or PC Print Care may remove your Account and data upon discontinuing it. You cannot own your Account.

4.6. User Account Deactivation Effect
Contact [email protected] to reactivate your Account if you willingly deactivated it. Reactivating PC Print Care-terminated accounts for any reason, including a breach of these Terms, requires its authorization, which may be withheld in its sole and absolute discretion.

5. Cancellation/Rescheduling

Our cancellation and rescheduling rules are at [PC Print Care Cancellation Policy](https://pcprintcare.online/cancellation-policy.html) and may change without notice.

6. Pricing/Payments

6.1. Costs
All Platform pricing, fees, and other amounts are listed on the Site (the “Fees”). US Dollars are used for all transactions. All Fees are subject to change without notice and are not confirmed until checkout. The checkout line item may include a platform fee. Unless otherwise stated herein or approved by PC Print Care in writing at its sole discretion, all payments are final and non-refundable, and Users may not cancel their purchases for any reason. The applicable Payment Provider agreement controls your use of PayPal or other payment or financial mechanisms (“Payment Provider”), and you should turn to that agreement, not these Terms, to determine your rights and duties. YOU WARRANT THAT YOU HAVE THE LEGAL RIGHT TO USE ANY PAYMENT MEANS TO INITIATE ANY TRANSACTION. You must supply accurate, current, and complete information to us or our third-party payment processors. Paying taxes on payments is also your responsibility. PC Print Care is not liable for the accuracy of Payment Provider information you give or your use of any Payment Provider (including any fees levied by such Payment Provider).

6.2. Transaction Failure
PC Print Care will tell you via email and/or the “My Account” page if it cannot charge any linked payment instrument, and you will be unable to place additional purchases or transactions. If PC Print Care notifies you of such failure, you undertake to attach a new, valid payment instrument within three business days. Your PC Print Care Account may be blocked until a valid payment instrument is given and PC Print Care resolves the uncharged debt. PC Print Care is not liable for payment instrument issuer charges due to missed charges. If PC Print Care cannot charge any payment instrument linked to your Account as payment for authorized transactions for more than 30 days, you understand and agree that PC Print Care may use a collection agency or other business to collect any outstanding debts and fees associated with your User Account, and you will not dispute the use of a third party. You agree to pay any legal, court, arbitration, or collection agency fees to fix your account and all owed money. You agree that PC Print Care, or any agency or business employed by PC Print Care, may contact you and your heirs via telephone, email, or in-person using the information you provided upon registration or during any contact with PC Print Care to collect any monies and fees owed under your account, whether specifically referenced in these Terms or not, in a manual or automated manner.

6.3. Subscriptions.

(a) Annual Subscriptions
Users can subscribe (a “Subscription Plan”). All subscription plans are annual and either annually or monthly. Monthly subscriptions are annual commitments.

(b) Cost You will be charged the subscription fee, plus any applicable taxes, set-up fee (if applicable), and other charges (“Subscription Fee”) at the start of your Subscription Plan and annually, as specified when you purchase it. Subscription Plans and Subscription Fees are described at [PC Print Care membership](http://localhost/webtech-final/membership) and may be updated without notice.

(c) Subscription Start Once you pay, your subscription plan begins. The “Annual Plan, Pay Annually” option charges the full annual Subscription Fee and taxes at the initial payment. If you choose the “Annual Plan, Pay Monthly” option, the first month’s Subscription Fee plus set-up fee and applicable taxes will be charged at the initial payment, and then the monthly Subscription Fee plus applicable taxes will be charged each month for the duration of the applicable year.

(d) Renew Unless you turn off auto-renewal, your Subscription Plan will renew automatically after one year. Your renewal rate may change, but you will be notified and given the option to cancel under these Terms. Plan auto-renewal can be disabled at any time (but must be done on or before the last business day before the renewal to avoid being charged for the renewed term), but the plan will remain active for the remaining months of the annual plan and you will be responsible for the applicable charges. Turn off auto-renewal under “My Account” or contact PC Print Care at [email protected]. If you do not renew, your Subscription Plan right to use the Platforms will last until the end of your current subscription period and then cease without further costs.

(e) Canceling “Annual Plan, Pay Annually” Subscriptions. If you choose the “Annual Plan, Pay Annually” option, you can quit within 30 days of the plan’s yearly term to get a refund of the Subscription Fee less any savings or reductions. You can cancel your Subscription Plan within 30 days by emailing [email protected] or calling 1-833-369-1227. Cancellations after 30 days are nonrefundable, and the Subscription Plan will continue until your current subscription period ends.

(h) Deactivation. Subscription Plans will be deactivated immediately for nonpayment. PC Print Care Services will be unavailable to deactivated plan users due to payment failure. To renew the Subscription Plan and update your account, you must pay any overdue payments.

7. Usage restrictions

7.1 Use Limits PC Print Care allows you to use the Platform for personal or limited commercial usage in accordance with its intended purpose. You promise not to:

(a) Modify, create derivative works, translate, reverse engineer, decompile, disassemble, or hack the Platform;

(b) Sell, assign, rent, lease, operate as a service bureau, or transfer Platform rights, including sublicense, to any other person or entity without PC Print Care’s express authorization;

(b) Misrepresent PC Print Care or the Platform;

(d) Launch, aid, or participate in any attack, including denial of service attacks, on the Platform (or any servers, systems, or networks connected to it) or attempt to obstruct, disrupt, or interfere with its operation or any other person’s or entity’s use of it;

(e) Try to access the Platform, other Users’ accounts, or Platform servers, systems, or networks without authorization;

(f) Commercially use the Platform unless compatible with these Terms and its intended use;

(g) Develop, produce, transmit, or store libelous, harmful, abusive, vulgar, or hateful content on the Platform;

(h) Upload, post, email, or otherwise transmit unsolicited or unauthorized advertising, promotional materials, “junk mail,” “spam,” “chain letters,” “pyramid schemes,” or any other solicitation or commercial electronic message;

(i) Breaking third-party agreements;

(j) Use the Platform for any illegal, forbidden, abnormal, or unusual behavior as determined by PC Print Care in its sole discretion;

(k) Use the Platform to harass, violate privacy, threaten, or harm children; perpetrate phishing, pharming, impersonation, or identity theft; or violate any applicable law, ordinance, rule, regulation, treaty, or self-regulatory guidelines.

(l) inappropriately obtain or seek to inappropriately gain Platform data, including User email addresses or mobile phone numbers;

(m) Intercept, inspect, or witness any Platform proprietary communications protocol using a network analyzer, packet sniffer, or other device; or

(n) Use any bot, spider, virus, clock, timer, counter, worm, software lock, drop dead device, Trojan horse, trap door, time bomb, or other codes, instructions, or third-party software to secretly access, distort, delete, damage, or disassemble the Platform.

8. Links

8.1. Platform links Independent third-party websites may be linked from the Platform. PC Print Care provides connections to other websites for convenience, but use is at your own risk. PC Print Care is not responsible for the content of connected websites or services. PC Print Care does not endorse any other website’s content and disclaims all liability for your access to and use of such connected websites. You accept that the terms of service and other agreements of connected websites govern your access and use of their services.

8.2. Platform links Unless otherwise stated in a written agreement between you and PC Print Care, you must follow PC Print Care’s linking policy: (a) the appearance, position, and other aspects of any link to the App or Site may not damage or dilute PC Print Care’s or its licensors’ names and trademarks; (b) the link may not create the false appearance that your organization or entity is a sponsor. PC Print Care may withdraw its approval to any link, including social media links, at any time. PC Print Care retains the right to revoke or change any link (including vanity links) to the Platform or your Account, including any social media link.

9. PC Print Care IP

9.1. Trademarks PC Print Care trademarks and service marks include its name and logo. You may not use PC Print Care’s trademarks, service marks, or logos without a signed agreement, which may violate federal and state trademark laws.

9.2. Ownership You acknowledge and agree that PC Print Care, or its licensors, owns all rights, title, and interest in and to the Platform, including all intellectual property, industrial property, and proprietary rights recognized worldwide at any time, and that the Platform is protected by US and international copyright laws. The Platform may contain confidential information, and you agree not to reveal it without PC Print Care’s explicit approval.

9.3. Feedback PC Print Care may invite you to contribute comments, bug reports, ideas, or other feedback concerning the Platform or any adjustments, features, or enhancements (“Feedback”). You accept that PC Print Care owns all Feedback and has the right to use it in any way and for any purpose. All Feedback rights, title, and interest are assigned to PC Print Care.

9.4. Repeat Infringer Policy Copyright Protests. In compliance with the Digital Millennium Copyright Act and other applicable law, we terminate the accounts of Users who regularly infringe intellectual property rights. If you think something on our Platform violates your copyright, contact PC Print Care:

The notice must include:

– Your contact information, including your address, phone number, and email; – A description of the alleged infringing work and its location; – A statement that you believe the disputed use is not authorized; – A signature of the authorized representative of the copyright owner; and –

10. Privacy Policy

By accepting these Terms or using the Platform, you agree to our Privacy Policy as well. The Privacy Policy may be updated by PC Print Care at any time and linked on the Site. You must immediately stop using the Platform if you disagree with the Privacy Policy. Continued use of the Platform implies acceptance of the then-current Terms and Privacy Policy stated on the Site.

11. Location

US-based PC Print Care runs the Platform. We may move, use, and retain your information in the US and other countries, where you may not have the same rights and protections as under local law, to provide our Platform. Access to the Platform from outside the US is at your own risk and subject to local regulations. Note that European Economic Area residents should not use the Platform.

12. Submitted Content

12.1. PC Print Care does not source, verify, endorse, or assume responsibility for the content of Platform communications or other materials submitted or made available through the Platform via any function allowing Users to post or share content (“Submitted Content”). By using the Platform, you acknowledge that other Users can read your Submitted Content. The submitter is responsible for Submitted Content, which may be offensive, unlawful, dangerous to kids, vulgar, indecent, or otherwise objectionable. Third-party intellectual property may protect submitted content. You must not submit material that (a) is protected by copyright, contains trade secrets, or is subject to third-party proprietary rights, including privacy and publicity rights, unless you are the owner or have permission from the rightful owner; (b) is false or a misrepresentation; or (c) is offensive, unlawful, harmful to minors, obscene, defamatory, libelous, threatening, pornographic, harassing, hateful, racially or eth To safeguard the Platform or Users or enforce these Terms, PC Print Care may prohibit, suspend delivery, or remove communications. If you violate these Terms, PC Print Care may remove your content and terminate your Account. You agree that PC Print Care may pre-screen your Submitted Content but is not required to. PC Print Care may modify or include Submitted Content in the Platform at its discretion.

12.2. PC Print Care does not own your submitted content You grant PC Print Care a perpetual, irrevocable, worldwide, royalty-free, sublicensable, fully paid-up, non-exclusive, and transferable license to use, reproduce, distribute, prepare derivative works of, display, modify, copy, and perform your Submitted Content in connection with the Platform and PC Print Care’s business, including for promoting, marketing, and redistribution. You offer each User a non-exclusive license to access your Submitted Content on the Platform while it is available. You may remove any of your Submitted Content from the Platform, but you acknowledge and agree that PC Print Care may still have access to it and that the above license granted by you to PC Print Care will remain in effect. You represent, warrant, and covenant that your Submitted Content does not contain text, photos, music, or video to which you do not have the full right to give the license in this Section.

12.3. You accept the entire responsibility for your Submitted Content You agree that PC Print Care is not liable for any Submitted Content, including any errors or omissions in such Content or any loss or damage incurred as a result of using or distributing such Content via the Platform.

13. Use Your Computer or Device

Some Platform features require access to your PC or other device. You authorize the Platform to monitor your computer or other applicable device (including its memory) and send information, including your Account information, to PC Print Care’s servers for device performance analysis. The Platform will also use your computer’s processor, bandwidth, hard drive (or other memory or storage hardware), and/or cache to facilitate communication between you and other users and the operation of the Platform’s network of computers.

14. Mobile messaging T&Cs

14.1. We will contact you via email, text (to the extent permitted by law), calls, and browser notifications if you agree to these Terms or use the Platform. We may respond to inquiries, operationally manage orders, request feedback, or send marketing materials (only after your consent).

14.2. These Mobile Messaging Terms and Conditions (for purposes of this Section 14, the “Mobile Messaging Terms”) govern your usage of PC Print Care’s mobile messaging program (the “Program”). By opting in to or participating in any of our Programs, you accept and agree to these Terms, including our binding, individual-only arbitration clause in Section 19 (Binding Arbitration). These Mobile Messaging Terms apply only to the Program and do not change other Terms or PC Print Care’s privacy policy.

14.3. Opt-In. Online enrollment forms allow you to opt into the Program to receive SMS/MMS mobile messaging. You agree that these Mobile Messaging Terms apply to your Program participation regardless of the opt-in method you used, and that third-party service providers that help us run the Program may receive your information. You consent to auto-dialed or prerecorded marketing mobile messages at your opt-in phone number by participating in the Program. You consent to receive auto-dialed messages, however this does not mean that all of our mobile communications are sent using an ATDS. You may pay for messages and data.

14.4. Opt-Out You agree to reply STOP to any PC Print Care mobile message to opt out of the Program or these Mobile Messaging Terms. An extra mobile message may confirm your opt-out. This is the only reasonable way to opt out, you agree. You also understand and agree that texting words other than STOP or directly requesting that one of our workers remove you from our list is not an acceptable way to opt out.

14.5. Notice and Indemnify You agree to complete the User Opt-Out process before discontinuing use of the mobile telephone number used to subscribe to the Program, including canceling your service plan or selling or transferring it. You acknowledge that this is a key provision of these Terms. You also agree that if you discontinue the use of your mobile telephone number without notifying PC Print Care, you will be responsible for all costs (including attorneys’ fees) and liabilities incurred by PC Print Care or any party assisting in mobile message delivery due to claims brought by individuals who are later assigned that number. This responsibility and these Mobile Messaging Terms will survive any cancellation or termination of your Program participation. YOU AGREE TO INDEMNIFY, DEFEND, AND HOLD US HARMLESS FROM ANY CLAIM OR LIABILITY RESULTING FROM YOUR FAILURE TO NOTIFY US OF CHANGES IN YOUR INFORMATION, INCLUDING TELEPHONE CONSUMER PROTECTION ACT, 47 U.S.C. § 227, OR SIMILAR STATE AND FEDERAL LAWS, AND REGULATIONS RESULTING FROM US CONTACTING YOU AT YOUR MOBILE NUMBER.

14.6. Program Description Participants in the Program may get notifications about Booking changes, feedback, and marketing and sales of products, services, and events.

14.7. Cost and frequency You may pay for messages and data. Your involvement with PC Print Care may trigger subsequent mobile communications as part of the Program.

14.8. MMS Disclosure The Program will send SMS TMs if your phone doesn’t support it (only after your consent).

14.9 Our Warranty Disclaimer: The Program is “as-is”. It may be unavailable in some places. – Wireless carrier product, software, coverage, or other changes may disable it. PC Print Care is not responsible for Program-related mobile communication delays or outages. Mobile message delivery is managed by your wireless service provider/network operator, not PC Print Care.

14.10 Participant Needs: You need a two-way wireless device. – Use a participating wireless carrier. – Must have wireless text messaging service. Not all cell phone providers offer enough service to participate. Check device specs for text messaging instructions.

15. No endorsement limited warranty; warranty disclaimer: PC Print Care does not endorse Configuration. PC Print Care does not advocate any Configuration. PC Print Care is not responsible for the accuracy or completeness of Configuration information posted on the Platform. PC Print Care guarantees good, workmanlike service. Services are defect-free for 90 days after completion. PC Print Care excludes all warranties and conditions, including quality, merchantability, fitness for a particular purpose, and non-infringement. PC Print Care cannot guarantee the correctness, completeness, or reliability of Platform contents, information, or data. PC Print Care does not guarantee Platform availability, timeliness, security, or faultlessness. PC Print Care does not guarantee the Platform is virus-free. Configuration are not PC Print Care agents. PC Print Care only offers remote technical support. PC Print Care does not guarantee a Configuration’s work or compliance with laws, regulations, or codes.

16. LIABILITY LIMIT:
PC Print Care and its Parties are not liable for indirect, incidental, consequential, special, punitive, or exemplary damages. – This includes loss of revenues, use, data, or goodwill from Platform access or use. – PC Print Care and its Parties’ aggregate liability shall not exceed $500 or your Service costs. – Not all jurisdictions allow limited liability or exclusion of warranties, conditions, or representations, thus not all limits may apply.

17. Indemnification: You undertake to defend, indemnify, and keep PC Print Care and the other PC Print Care Parties harmless from all claims, demands, obligations, damages, and losses. – This includes reasonable attorneys’ fees arising from your Platform use or these Terms breach.

18. Law and jurisdiction: – California law governs these Terms without regard to conflict of laws. The UN Convention on Contracts for the International Sale of Goods does not apply. – Only Los Angeles state and federal courts will handle disputes relating to these Terms or your Platform use. You consent to these courts’ personal jurisdiction and venue. PC Print Care can seek equitable remedies (including injunctions) wherever.

19. Arbitration binding: All disputes, conflicts, and claims connected to these Terms or the Platform must be handled by binding arbitration. JAMS Streamlined Arbitration Rules and Procedures will govern arbitration. Arbitration will be in Los Angeles, California, unless otherwise agreed. – Class-action arbitration is not allowed. – You and PC Print Care agree that any arbitration will be confined to your Claim. PC Print Care’s intellectual property rights, theft, piracy, invasion of privacy, illegal use, and equitable relief claims are exempt from arbitration. JAMS Rules apply to arbitration fees. If any part of Section 19 is illegal or unenforceable, the rest will stand. You agree that these Terms’ disclaimers, exclusions, and liability restrictions are fundamental to the agreement.

20. General

20.1. No partnership These Terms and your use of the Platform do not create a joint venture, partnership, employment, or agency relationship between you and PC Print Care.

20.2. Assignment Without your approval, PC Print Care may assign these Terms to anybody. You cannot assign these Terms’ rights without PC Print Care’s express authorization, and any effort to do so would be null and invalid.

20.3. Severability Any invalid or unenforceable part of these Terms shall be severed, and the rest shall remain in force.

20.4. Attorney Fees Except as otherwise provided in Section 19.5, the prevailing party in any litigation or arbitration related to these Terms shall be entitled to recover from the other party all reasonable costs, attorneys’ fees, and other expenses.

20.5. No waiver Our omission to enforce any term of these Terms shall not be interpreted as a waiver of such provision or affect our right to enforce it later. An express waiver by PC Print Care of any provision, condition, or requirement of these Terms does not waive your duty to comply with the same subsequently.

20.6. Notices You must notify [email protected] in writing of all notices required by these Terms.

20.7. Export Administration You must comply with all US and foreign export laws and regulations (“Export Controls”) and shall not export, direct, or transfer any portion of the Platform or any direct product thereof to any destination, person, or entity restricted or prohibited by the Export Controls.

20.8. Fair Treatments You acknowledge and agree that PC Print Care would be irreparably damaged if these Terms were not specifically enforced, and therefore you agree that we shall be entitled, without bond, other security, or proof of damages, to appropriate equitable remedies for breaches of these Terms, in addition to any other remedies we may have under applicable laws.

20.9. Complete Agreement These Terms, including the documents referenced in them, comprise the complete agreement between you and PC Print Care about the Platform and supersede any earlier agreements.
